1. Eligibility

The Service is intended only for adults. You must be at least 18 years old, or the age of legal majority where you live if it is higher, to access or use the Service. By using the Service, you represent that you meet this requirement.

2. Accounts

Certain features require you to sign in with a Discord account. You are responsible for maintaining the security of your account and for all activity that occurs under it. Your use of Discord is subject to Discord's own terms and policies.

3. Library sounds

Many sounds in our library are clips of third-party works. We do not claim ownership of these sounds, and all rights in them belong to their respective owners. Library sounds are made available for personal, non-commercial use, such as in a Discord server soundboard. We do not grant you any rights in third-party sounds, and you are responsible for ensuring that your use of any sound complies with applicable law. We may add, modify or remove library sounds at any time. This section does not apply to sounds you generate, which are covered in Section 4.

4. AI generated content

The Service allows you to generate audio ("Output") using third-party artificial intelligence providers. As between you and us, we do not claim ownership of your Output, and you may use it subject to these Terms and the terms of our AI providers. You are solely responsible for the text you submit and for your use of any Output. Output may be inaccurate or unexpected, may be similar to content generated for others, and may not be protected by copyright. We do not guarantee that Output is free from third-party rights. Usage limits and credits may be changed at any time, have no cash value, and are not transferable or refundable.

5. Prohibited conduct

You agree not to:

• use the Service in violation of any applicable law or regulation
• generate content that impersonates any person, or that is unlawful, defamatory, harassing, hateful, sexually explicit or otherwise objectionable
• use generated content to deceive, defraud or mislead others
• infringe or misappropriate the intellectual property or other rights of any third party
• circumvent usage limits, or access the Service by automated means without our permission
• interfere with or disrupt the Service or its underlying systems

6. Intellectual property

The Service, including its design and software but excluding third-party sounds, is owned by us and is protected by intellectual property laws. Nothing in these Terms grants you any right to use our name, logos or other intellectual property.

7. Copyright complaints

We respect the intellectual property rights of others. If you believe that content available through the Service infringes your copyright, please send a notice to [email protected] that includes: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (f) your physical or electronic signature. We will respond to valid notices and remove infringing material where appropriate.

8. Third-party services

The Service relies on and may link to third-party services that we do not control. We are not responsible for third-party services, and your use of them is at your own risk and subject to their terms. Soundboard library is not affiliated with, sponsored by or endorsed by Discord.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination will survive, including Sections 6 and 10 through 13.

10. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error free or secure.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100).

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses and expenses, including reasonable legal fees, arising out of your use of the Service, your content, or your violation of these Terms.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.

14. Changes to these Terms

We may revise these Terms from time to time. If we make changes, we will post the updated Terms on this page and revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
